General Terms and Conditions (GTC)

1. Scope
1.1 These General Terms and Conditions (GTC) apply to all orders placed by consumers (§ 13 BGB) and entrepreneurs (§ 14 BGB) via our online shop Schweighöfer Tortechnik .
1.2 Consumers are natural persons who enter into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity. Businesses are natural or legal persons or partnerships with legal capacity who, when concluding a contract, act in the exercise of their commercial or independent professional activity.
1.3 Any differing or conflicting terms and conditions of entrepreneurs shall not become part of the contract unless we expressly agree to their validity in writing.
2. Contracting parties, conclusion of contract
2.1 The purchase agreement is concluded with Schweighöfer Tortechnik .
2.2 The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order. By clicking the order button, you submit a binding order.
2.3 The order confirmation does not yet constitute acceptance of the contract. The contract is concluded upon dispatch of an order confirmation or upon delivery of the goods.
3. Contract language, contract text
3.1 The contract language is German and English.
3.2 The contract text is not saved. Order details and these terms and conditions will be sent by email.
4. Prices, sales tax and shipping costs
4.1 All prices include statutory VAT plus shipping costs.
4.2 Shipping costs are shown separately during the order process.
4.3 For deliveries to non-EU countries, additional customs duties, taxes or fees may apply, which are to be borne by the customer.
4.4 Business customers / VAT
Online orders placed through our online shop are always invoiced including VAT . This also applies to orders from other EU countries (OSS procedure).
A subsequent switch to a net invoice is not possible.
Tax-free B2B orders (e.g., intra-community deliveries) are only possible after prior individual request via email .
4.5 For bulky or particularly heavy goods (e.g. garage doors, freight forwarding goods), shipping costs may vary depending on the supplier and delivery address.
5. Delivery and Shipping
5.1 We deliver exclusively to Germany, Austria and Luxembourg (excluding islands).
Deliveries to other countries are only made after prior individual agreement.
5.2 The stated delivery times are non-binding guidelines and begin after receipt of payment. Deviations are possible, particularly for custom-made products, supplier goods, or shipments via freight carrier.
5.3 Garage doors and bulky goods are delivered by freight carrier using a truck (up to 18 m in length) to the curb . The customer must ensure that the delivery address is accessible for such a vehicle.
5.4 If the delivery address is unsuitable, the customer must inform us before placing the order. Otherwise, we accept no liability for delivery delays or additional costs.
5.5 The customer is obliged to accept the goods on the agreed delivery date. The customer shall bear the costs for failed deliveries or repeat delivery attempts.
5.6 Unloading will take place at an easily accessible location at the specified delivery address. Unloading at other locations is at the customer's risk.
5.7 If unloading with a truck-mounted forklift is not possible, the customer must provide sufficient unloading personnel.
5.8 Partial deliveries are permitted insofar as they are reasonable for the customer.
6. Collection
6.1 Collection from the warehouse is possible by prior appointment.
6.2 In the case of collection, the risk of accidental loss passes to the customer upon handover of the goods.
7. Payment
7.1 The payment methods offered in the online shop are available.
7.2 For advance payments, the invoice amount is due within 7 days. If payment is not received, we reserve the right to cancel the order.
8. Right of withdrawal
8.1 Consumers have a statutory right of withdrawal in accordance with the cancellation policy.
8.2 There is no right of withdrawal for contracts
– for the supply of goods that are not prefabricated and for whose production an individual selection or specification by the consumer is decisive or
– which are clearly tailored to the personal needs of the consumer
(e.g. garage doors, custom-made products).
8.3 Entrepreneurs are not granted a right of withdrawal.
9. Returns
9.1 The customer shall bear the direct costs of the return shipment unless otherwise agreed.
9.2 We kindly request that you contact us in advance regarding returns to ensure a smooth process.
10. Retention of title
The goods remain our property until full payment is received.
11. Warranty
The statutory warranty rights apply.
For businesses, the warranty period for new goods is 12 months.
12. Liability
We are liable without limitation in cases of intent, gross negligence, and under the Product Liability Act.
In cases of slight negligence, liability is limited to breaches of essential contractual obligations and to foreseeable damages.
13. Data Protection
Personal data is processed in accordance with our privacy policy.
14. Dispute Resolution
We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
15. Final Provisions
15.1 The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.
15.2 If the customer is an entrepreneur, the exclusive place of jurisdiction is our place of business.
